Please read these Terms and Conditions carefully before using the Shopped platform — including the website at www.shoppedmw.com and the Shopped Android app. By using the platform, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you may not use the platform.
1. Acceptance of Terms
By accessing or using the Shopped platform, you agree to be bound by these Terms & Conditions and all applicable laws and regulations. If you do not agree, do not use the platform.
2. Platform Description
Shopped is a marketplace that connects buyers and sellers across Malawi, enabling the discovery and purchase of local products through mobile money payments.
3. User Accounts
- You must provide accurate, current, and complete information when registering.
- You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
- Only one account per person is permitted.
- You must notify us immediately of any unauthorised use of your account.
4. App Usage
- You agree to use the platform only for lawful purposes and in accordance with these Terms.
- You shall not use the platform to engage in any activities that are prohibited by applicable laws or regulations.
- You shall not interfere with or disrupt the operation of the platform or its associated services.
5. Buyer Obligations
- Pay for orders promptly after placement.
- Provide an accurate delivery address.
- Only request refunds for legitimate reasons.
6. Seller Obligations
- List products accurately and honestly — descriptions, images, and prices must reflect the actual item.
- Fulfil orders within the agreed timeframe.
- Maintain accurate stock quantities at all times.
- Do not list or sell prohibited items (see Section 7).
7. Prohibited Items
- The platform strictly prohibits the sale or promotion of firearms, ammunition, explosives, or any other weapons.
- The platform strictly prohibits the sale or promotion of illegal drugs or substances, including but not limited to narcotics, prescription medications without authorisation, and recreational drugs.
- Counterfeit or stolen goods may not be listed.
- Any user found engaging in the sale or promotion of prohibited items will be subject to immediate account suspension or termination, and their activities may be reported to the relevant authorities.
8. Prohibited Conduct
You shall not engage in any conduct that:
- Violates any applicable laws, regulations, or third-party rights.
- Harasses, threatens, or harms other users or the platform owner.
- Interferes with the security, integrity, or performance of the platform.
- Uploads or transmits viruses, malicious code, or other harmful materials.
9. Payments
- All transactions are processed in Malawian Kwacha (MWK).
- Payment is processed via PawaPay or PayChangu mobile money services.
- Shopped acts as an intermediary, holding funds in escrow until successful delivery is confirmed.
- Shopped charges a platform fee on each transaction. The fee percentage is set by admin and may change.
- Sellers receive their payout after an order is confirmed as delivered.
10. Refunds & Disputes
- Buyers may request a refund within 48 hours of delivery if the item is not as described.
- Sellers have 24 hours to accept or deny the refund request.
- Shopped admin will mediate any unresolved disputes.
- Shopped shall not be liable for any disputes, losses, or damages arising from transactions conducted through the platform.
11. Privacy
Your privacy is important to us. Please refer to the Shopped Privacy Policy for information on how we collect, use, and disclose your personal data. By using the platform, you consent to the collection and use of your information as described in the Privacy Policy.
12. Intellectual Property
- All platform content — including the Shopped logo, brand, user interface, text, graphics, and software — is owned by Shopped MW or its licensors and is protected by applicable intellectual property laws.
- You are granted a limited, non-exclusive, non-transferable licence to access and use the platform for personal, non-commercial purposes.
- You may not modify, reproduce, distribute, display, or create derivative works based on the platform or its contents without written permission from Shopped MW.
13. Limitation of Liability
Shopped is a marketplace platform and is not liable for the conduct of sellers or the quality of products listed. Transactions are between buyers and sellers directly. To the maximum extent permitted by applicable law, Shopped MW and its affiliates shall not be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with the use of the platform.
14. Indemnification
You agree to indemnify, defend, and hold harmless Shopped MW and its affiliates from and against any claims, liabilities, damages, losses, costs, or expenses arising out of or in connection with your use of the platform or any violation of these Terms.
15. Termination
- Shopped MW reserves the right to suspend or terminate your access to the platform at any time and for any reason, including but not limited to violations of these Terms.
- Upon termination, all rights and licences granted to you under these Terms will immediately cease.
16. Amendments to These Terms
- Shopped MW reserves the right to modify or revise these Terms at any time to reflect changes in our practices, platform functionality, or legal requirements.
- Updated Terms will be communicated through the platform or via email.
- Your continued use of the platform after updated Terms have been posted constitutes your acceptance of the revised Terms.
17. Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.
18. Entire Agreement
These Terms constitute the entire agreement between you and Shopped MW regarding the use of the platform and supersede any prior or contemporaneous agreements, understandings, or representations.
19. Governing Law
These Terms are governed by and construed in accordance with the laws of the Republic of Malawi. Any disputes arising out of or in connection with these Terms shall be subject to the jurisdiction of the courts of Malawi.
